End-User License Agreement

1. Acceptance of Terms

This End-User License Agreement ("Agreement") is a legally binding agreement between you ("User," "you," or "your") and SIM TECH TRACKER, including its owners and affiliates ROLANDONIEVES.COM, MYTECHREVIEW, and SIMTECHTRACKER.COM ("Company," "we," "us," or "our").

By downloading, installing, accessing, or using the SIM TECH TRACKER application ("App") or related services, including the website SIMTECHTRACKER.COM, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree to these terms, you must not use the App or Website.

2. Flight Simulator Use Only – Critical Disclaimer

The App and associated services are designed exclusively for use with flight simulation software operating in a virtual, non-real-world environment.

The App must NOT be used for:

• Real-world aircraft operation
• Live flight planning, navigation, or monitoring
• Pilot decision-making in real aircraft
• Real-world flight instruction, certification, or training
• Any safety-critical or operational aviation activity

SIM TECH TRACKER is not certified, approved, or endorsed by the FAA, EASA, ICAO, or any aviation authority.

Any use outside of a flight simulation environment is strictly prohibited and done entirely at your own risk.

3. License Grant

The Company grants you a limited, non-exclusive, non-transferable, revocable license to use SIM TECH TRACKER solely for personal or authorized flight simulation purposes, subject to this Agreement.

This license does not transfer ownership of the App, software, or intellectual property.

4. Restrictions on Use & Code Protection

You expressly agree that you will NOT:

• Decrypt, decompile, reverse engineer, disassemble, or attempt to derive source code
• Modify, copy, distribute, resell, sublicense, lease, or exploit the App
• Use the App, Website, or codebase to create or assist in creating competing or similar applications
• Circumvent security, licensing, or access controls
• Use the App or Website for unlawful, unauthorized, or non-simulator purposes

Any violation may result in immediate termination, permanent bans, and potential legal action.

5. Data Collection & User Consent

By accepting this Agreement, you explicitly consent to the collection, processing, and storage of data, including but not limited to:

• User information
• Flight simulator data
• App usage metrics
• Error logs, crash reports, and diagnostic data

Purpose of Data Collection:

• App functionality and stability
• Debugging and performance monitoring
• Feature development and improvements
• Internal analytics related to SIM TECH TRACKER

6. Ownership & Intellectual Property

All rights, title, and interest in and to the App, Website, software, content, design, branding, and trademarks are owned exclusively by the Company.

Protected trademarks include:

• SIM TECH TRACKER
• ROLANDONIEVES.COM
• MYTECHREVIEW
• SIMTECHTRACKER.COM

Unauthorized use of any intellectual property is strictly prohibited.

7. Right to Suspend or Terminate Access

The Company reserves the absolute right, at its sole discretion, to:

• Suspend or terminate your access to the App or Website
• Permanently or temporarily ban users
• Revoke access to affiliated services, links, or platforms

These actions may be taken with or without notice, for any reason, including violation of this Agreement.

8. No Warranty

SIM TECH TRACKER is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied.

The Company disclaims all warranties, including but not limited to:

• Accuracy or reliability of simulator data
• Fitness for real-world aviation use
• Uninterrupted or error-free operation

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any damages arising from:

• Use or inability to use the App or Website
• Use of the App outside of flight simulation environments
• Data inaccuracies, simulator errors, or integration issues
• Loss of data, profits, access, or functionality

You assume all risks associated with use of the App and Website.

10. Termination

This Agreement remains effective until terminated by you or the Company.

Upon termination, you must immediately:

• Cease all use of the App and Website
• Delete all copies of the App in your possession

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding SIM TECH TRACKER and supersedes all prior agreements or understandings.
